When you need an Arabic divorce certificate translation

You will usually need an Arabic divorce certificate translation for remarriage at the registry office, which requires proof that the earlier marriage was dissolved, for a residence permit at MA 35 after a separation, for maintenance and custody proceedings at the district court, or for updating your marital status in the central register of residents.

These offices accept certified translations only. They are produced by court sworn and certified translators in Austria, carry a stamp, signature and certification clause, and are firmly attached to a copy of the original.

Divorce judgment, talaq confirmation or register extract

In Arabic countries a marriage is dissolved in different ways, and each way produces a different document. Which one the Austrian authority needs depends on the procedure.

Court divorce judgment

Judgment of the sharia or personal status court with case number, parties, grounds and finality endorsement. Usually the most informative document for authorities.

Talaq confirmation

The court certified repudiation by the husband, often a short certificate. Without court registration it is generally not recognised.

Khul divorce

Divorce initiated by the wife in return for waiving the dower, confirmed by the court. The translation explains the term in a note.

Divorce certificate from the civil register

The short extract with register number and date of dissolution. Often sufficient for the registry office once the judgment is final.

Typical pitfalls with Arabic divorce documents

Divorce judgments are legal texts with religious terms that have no equivalent in Austrian law. The translation must render and explain them precisely without reinterpreting them. Four points matter most in practice:

  • Finality: Austrian offices ask whether the judgment is final. If the finality endorsement is missing on the original, we tell you before translating.
  • Terms such as talaq, khul, idda or revocable and irrevocable divorce are translated and explained in a translator's note.
  • Names of both spouses exactly as in the passports, and the dates of marriage and divorce converted where a Hijri date is used.
  • Handwritten notes, court stamps and foreign ministry stamps are reproduced in full, with illegible passages marked as illegible.

Recognition of foreign divorces and legalisation

Whether an Arabic divorce is recognised in Austria is examined by the authority in the respective procedure, the registry office for remarriage, the court in maintenance matters. In some cases a separate recognition procedure is required. Before translation the original usually needs authentication:

  • Syria, Iraq, Egypt, Jordan and Lebanon are, to our knowledge, not party to the Hague Apostille Convention. The usual route is legalisation via the justice and foreign ministries of the country of origin and the Austrian representation there.
  • Gulf states: Saudi Arabia, Oman and Bahrain generally work with the apostille, while the United Arab Emirates, Qatar and Kuwait usually require legalisation.
